Privacy Policy for Participants
We recommend that you (“Participant”) carefully read this personal data processing policy regarding the processing of personal data for the purposes of (i) monitoring the use of the website www.zvaracak.sk (“Website”), (ii) creating an account on the Website for the purpose of participating in the architectural competition for the new design of the Zváračak complex on Račianska Street (“Competition”), (iii) participation in the Competition, and (iv) fulfilling legal obligations related to potential compensation for participation in the Competition.
The organizer of the Competition and operator of the Website is Račianska Reality‑Reality, a.s., with its registered seat at Račianska 71, 831 02 Bratislava, Slovak Republic, Company ID: 51284219, registered in the Commercial Register of the Municipal Court Bratislava III, Section Sa, File No. 6702/B (“Controller”).
The Participant’s privacy is important, and therefore the Controller prioritizes ensuring the highest level of security and protection of personal data during processing. The Controller processes personal data in accordance with Regulation (EU) 2016/679 (“GDPR”) and Act No. 18/2018 Coll. on Personal Data Protection (“Act”).
All necessary information on personal data processing under GDPR and the Act is provided in this Policy.
I. What are the purposes of processing personal data?
Personal data is processed according to this Policy. The Participant, as the data subject, provides personal data for the following purposes:
- monitoring use of the Website through cookies;
- creating an account on the Website to participate in the Competition;
- participation in and execution of the Competition, and fulfillment of the Controller’s rights and obligations arising from the Competition;
- fulfilling legal obligations related to potential compensation for participation in the Competition.
II. What personal data is processed?
The Controller processes only the personal data necessary to achieve the purposes, such as:
- unique identifier and IP address;
- name and surname of the Participant or their contact person, email, phone number, information on registration in the Chamber of Architects;
- name and surname of the Participant or their contact person, email, phone number, bank account number;
- name and surname of the Participant or their contact person, bank account number, and other data necessary for tax and accounting purposes.
III. What is the legal basis for processing personal data?
1. Legitimate interest
If the Participant decides to use the Website, the Controller processes personal data through cookies. The legal basis is the Controller’s legitimate interest under Art. 6(1)(f) GDPR—ensuring a better user experience.
2. Contract performance
Creating an account for participation in the Competition and participation in the Competition itself constitutes a contractual relationship between the Participant and the Controller. Therefore, the legal basis is performance of a contract under Art. 6(1)(b) GDPR. Without providing personal data, participation or account creation is not possible.
3. Legal obligations
If the Participant meets all the conditions of the Competition, they may become entitled to compensation. This creates legal (tax and accounting) obligations for the Controller, therefore the legal basis is compliance with a legal obligation under Art. 6(1)(c) GDPR. Without data, compensation cannot be paid.
IV. How long is personal data stored?
Personal data is erased once it is no longer necessary for the purposes for which it was collected, unless legal retention obligations apply. Some personal data may be kept until the end of limitation or preclusive periods.
V. With whom is personal data shared?
Personal data may be processed by third‑party service providers used by the Controller to achieve the purposes of processing. Data may also be shared with Competition jury members and other experts.
Personal data is also shared with processors acting on behalf of the Controller.
Data is processed within the Slovak Republic and the EU. Data may be transferred outside the EU only to countries with an adequate level of protection or with sufficient safeguards (e.g., binding corporate rules, standard contractual clauses).
VI. What is the source of personal data?
In some cases, Participants may be represented by other persons (contact persons or authorized representatives). In such cases, the Controller obtains personal data from the Participant or publicly available sources.
VII. What are the Participant’s rights?
Participant rights (subject to conditions under Chapter III GDPR):
- Right of access
- Right to rectification
- Right to completion of incomplete data
- Right to restriction of processing
- Right to erasure
- Right to object
- Right not to be subject to automated decision‑making
- Right to data portability
- Right to lodge a complaint with a supervisory authority
VIII. How can the Participant exercise their rights?
